This document presents a public offer for remote sale of products via an online store by Individual Entrepreneur V.V. Semenchenko

1. General Provisions

1. This public offer (hereinafter the Offer) constitutes an official proposal to any individual to enter into a remote retail purchase and sale agreement for products subject to the terms and conditions specified in this agreement, which describes all essential conditions of the Offer.
2. By placing an order for a product listed on the website, the buyer accepts all the terms and conditions of this Offer, the Privacy Policy, and the User Agreement.
3. The Seller reserves the right to modify the Offer without prior notification to the buyer.
4. The Offer is perpetual, unless otherwise indicated on the website.
5. The Seller provides the buyer with comprehensive and accurate information about the goods/services, including details about the principal consumer qualities of the product, its place of manufacture, as well as information regarding the warranty period and the product’s shelf life, all available on the website.

2. Subject of the Offer

1. The seller undertakes to deliver to the buyer the products intended for personal, family, household or other non-business-related use, based on the orders placed. Simultaneously, the buyer agrees to accept and pay for the products subject to the terms of this Offer.
2. Specific details such as the product name, price, quantity, and other essential terms of the Offer will be determined based on the information provided by the buyer during the order placement process.
3. Title to the products ordered shall be transferred to the buyer upon the actual delivery of the product to the buyer and full payment of the product price. The risk of accidental loss or damage to the goods passes to the buyer upon the actual delivery of the product to the buyer.

3. Product pricing

1. The product prices are unilaterally and indisputably determined by the seller and are displayed on the web pages of the online store.
2. The final product price may be subject to changes by applying any of the following discounts:
   special offer/promotion discounts;
   promo codes for discounts;
   loyalty discounts.

4. Offer Acceptance

1. This Offer (agreement) shall be deemed accepted when the buyer places an order for the products subject to the terms outlined in this Offer. 4. his/her registration data (including personal data) is transmitted in electronic form via Internet communication channels;
5. his/her registration data (including personal data) is shared with the seller for the purposes described in this Offer, the Privacy Policy, and the User Agreement. The data may also be shared with third parties to serve the purposes described in this Offer;
6. his/her registration data (including personal data) may be used by the seller to promote products and services through direct communication channels with the buyer;
7. for additional protection against fraudulent activities, the registration data (including personal data) provided by the buyer may be shared with the bank responsible for processing payment transactions related to the orders placed;
8. the buyer’s consent to the processing of his/her registration data (including personal data) is perpetual and can be revoked by the buyer or his/her legal representative through a written application submitted to the seller.

5. Product Purchase and Delivery Terms

1. The buyer can purchase the products on the website and pay using any of the following methods: credit/debit card or wire transfer based on the invoice issued.
2. The buyer hereby agrees that the chosen payment method cannot be modified once the order is placed on the website.
3. The buyer further agrees that the order paid by credit/debit card or wire transfer is only confirmed once the withdrawal of funds from the payment account for the order is validated.
4. The buyer acknowledges that the order must be paid within one calendar day from its placement on the website.
5. The buyer agrees that if the order remains unpaid beyond the specified time frame, the order may be canceled.
6. The website offers product delivery using the following methods: own delivery service (courier delivery or delivery to designated self-pickup points). The buyer, in coordination with the website, may also arrange for alternative delivery methods depending on his/her region/country or upon mutual agreement.
7. The products will be delivered to the buyer within the agreed-upon timeframe, once the order is confirmed by a seller’s representative.
8. In case of delivery by courier, the buyer is required to sign the delivery log next to the items they have purchased. The signature confirms that the buyer has no objections with regard to the contents, quantity, and condition of the product.
9. No claims concerning the content, quantity and condition of the product will be accepted once the product is received.
10. The buyer agrees that the website may share the buyer’s personal information with third parties for delivery purposes.
11. The buyer also agrees that failure to receive the products due to his/her own actions, including exceeding the period during which the buyer is required to collect the products, will be considered by the website as refusal of the products. In this case, the products will be returned to the website, and the order will be canceled.
12. In the event of the buyer refusing the products, or the products ordered being unavailable, any payment made for the products will be refunded to the buyer within ten calendar days upon request, less the costs incurred by the website in relation to the delivery of the products.

6. Returns and refunds

1. Returns and refunds are provided in accordance with the Law on Consumer Rights Protection and other applicable regulations.

7. Offer validity term

1. This offer comes into effect upon its acceptance by the buyer and remains effective until acceptance of the public offer is withdrawn.

8. Additional terms and conditions

1. The Seller reserves the right to assign or transfer its rights and obligations arising from its relationship with the buyer to third parties.
2. The Seller and the services provided may become partially or entirely unavailable due to maintenance or other activities, or for any other technical reasons. The website’s technical support team has the right to periodically perform maintenance or other activities, with or without prior notice to customers.
3. The legal provisions governing the relationship between the buyer and the Seller shall apply.
4. In case of questions or complaints from the buyer, they should contact the seller by phone or through other available means. Both parties shall take reasonable efforts to resolve any disputes through negotiations. If an agreement cannot be reached, the dispute will be submitted to a judicial authority in accordance with the current legislation.
5. The invalidation of any provision of this agreement by a court shall not affect the validity of the remaining provisions.
